- The Competition is open to UK residents, except employees of the Promoter, their families, agents or anyone professionally connected with the Competition. Entrants below the age of 18 must obtain parental or guardian permission. Such permission shall be verified before any prizes are awarded to these Entrants. Non-UK residents are welcome to vote, but sorry the promo is only open to UK residents.
- Entries classified as "Kids entries" must be created by children aged 10 or under. For children 11 years old or older , entries should be classified as an "Adult entry".
- Entries must be made using an official entry form available electronically at www.marmite.co.uk/marmart. Each Entrant must submit the completed entry form together with a photograph of his/her "Marmart". Photographs submitted electronically should be submitted as jpegs with a minimum size of 600kb. You may enter as many times as you like but each entry must be separate.
- No entries from agents, third parties, organised groups or applications automatically generated by computer will be accepted. Incomplete or corrupted entries or those not in accordance with the entry instructions will not be accepted.
- Responsibility is not accepted for any entries lost, damaged or delayed as a result of network, computer hardware or failures of any kind. Proof of sending is not proof of receipt.
- Marmite spread must be the only "paint" used on your "Marmart", (although butter or margarine can be used underneath if you choose). No other spreads or any other form of paint are to be used on your piece of "Marmart". The "Marmart" must be created on toast only. You may use as many pieces of toast as you like in each creation.
- The image or written message depicted in the piece of "Marmart" shall be the Entrant's own work. The image or message shall be original and shall not have been previously published or exploited in any part and will not infringe any copyright, right of privacy, right of publicity or personality or any other right whatsoever of any third party.
- All Entrants shall be the sole author of the "Marmart" and the sole absolute unencumbered legal and beneficial owner of all rights of copyright and other rights to the depicted image or message and the photograph, save for Entrants aged 10 and under.
- Entrants (except for those under 11) should be the sole author of the photograph. Entrants aged 10 and under may ask their parents/legal guardian to take the photograph in which case the parent or legal guardian shall be the sole author of the photograph and the sole absolute unencumbered legal and beneficial owner of all right s or copyright and other rights in the photograph.
- All Entries are eligible to be published on the "Marmart" online public viewing gallery on www.marmite.co.uk/marmart. Entrants hereby agree not to send to the Promoter any unlawful, threatening, harassing, libellous, defamatory, obscene, pornographic, racially or ethnically offensive or socially irresponsible material.
- Entrants who upload their photos onto the website will co-operate fully with the Promoter by email in the event that the Promoter requires clarification on photographs. If Entrants do not respond to such email seeking clarification, the photograph will not be published. If the Entrant responds, the image shall be published only if the Promoter is satisfied with the Entrant's response. The Promoter reserves the right to delete or remove any published photographs from the viewing gallery at any time without prior notice to Entrants. The decision of the Promoter regarding suitability for publication is final.
- Where repeated or serious infringements of rule 10 of these rules are committed, the Promoter may use information provided by such Entrants or inform appropriate third parties to ensure that such infringements cease. Entrants expressly acknowledge that their personal information may be passed to such third parties in these circumstances.
- Entrants shall indemnify and hold the Promoter harmless from any claims, actions, proceedings, costs and expenses arising as a result of any allegation that the images or messages depicted in the "Marmart" are not original or defamatory or that Entrants did not own or are not wholly entitled and authorised to allow publication and reproduction of the depicted image or message or the photograph of the "Marmart" by the Promoter.
- All Entrants hereby agree to irrevocably and unconditionally waive any rights to be identified as the author of the "Marmart" and photographs and other moral rights, which they may have now or obtain in the future.
- The judging criteria for all aspects of this promotion are originality, creativity, skill and style!
- There are no cash alternatives to any of the prizes stated. In the event of unforeseen circumstances the Promoter reserves the right to substitute all prizes for an alternative of equal or greater value. No correspondence will be entered into.
- Every week a panel of judges, which will include at least one independent judge shall choose the Pick of the Week [for each age group] from all the Entries submitted before 5 pm on Monday of each week. There shall be a different Pick of the Week for every week until the 28th February 2007 . The Pick of the Week shall win a weekly prize selected at the discretion of the Promoter. The preceding week's winners' details (name and county) and details of the prize for the following week shall be published on the website, www.marmite.co.uk/marmart by 9a.m (GMT) every Tuesday.
- All winners of the Pick of the Week will be eligible to win one year's worth of squeezy Marmite spread i.e. six 200g bottles. The overall winner shall be selected by our panel of judges using the judging criteria in rule 15.
- The Pick of the Week prizes shall be delivered to the Entrant's address as specified on the official entry form. Please allow 28 days from the closing date for delivery.
- All entries received by 12 midnight (GMT) on 30th September 2006 shall be eligible to win the grand prize of having their pieces of "Marmart" exhibited at a Central London Art gallery. These entries shall be put to a public vote via the website from the 1st October 2006. Voting shall be closed by 12pm (GMT) on 8th October 2006 . The criteria for voting is the same as the judging criteria specified in rule 15.
- Fifteen (15) kids' entries and fifteen (15) adult entries with the most votes will have their pieces of "Marmart" shown at a Central London Art Gallery between 22nd and 28th October 2006.
- The thirty Grand Prize Winners shall be notified by post or telephone by 10th October 2006. The Winners must claim their prize before the 17th October 2006 otherwise they will be treated as having forfeited their prize, in which case the Promoter reserves the right to offer the forfeited prize to a substitute winner selected in accordance with the Competition rules.
- The Grand Prize Winners' details (name and county) shall be posted on www.marmite.co.uk/marmart, once the Winners have been notified and claimed their prizes.
- The Winners hereby grant to the Promoter a perpetual and royalty-free licence to reproduce and use the photographs of the winning pieces of "Marmart". The Promoter hereby agrees to use the photographs for the exhibition, advertising activity relating to the exhibition and for Marmite brand related promotional activity only. The Promoter also agrees to identify the Winners in relation to their entry where possible and appropriate. The Winners agree to execute all such documents as may be required to grant this licence to the Promoter at any time.
- The Grand Prize Winners may be required to participate in publicity arising from this Competition.
- By entering the Competition, all entrants will be deemed to have accepted and be bound by the rules and consent to the transfer of their personal data to the Data Controller for the purposes of the administration of this Competition and any other purposes to which the entrant has consented. All entry instructions form part of the rules.
- These terms and conditions shall be governed by English law and the courts of England and Wales shall have exclusive jurisdiction.
